iProStep, LLC Website Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the iProStep website and any purchases of products and/or services through the website (including Shopify checkout) from iProStep, LLC (“iProStep,” “we,” “us”). By using the website or placing an order, you agree to these Terms.

If you do not agree, do not use the website or purchase from us.


1) Who We Are

iProStep is a contractor that sells flooring-related products and provides installation services. We are not a manufacturer of flooring products.

2) Changes to These Terms

We may update these Terms from time to time. The “Last updated” date reflects the latest version. Continued use of the website after updates means you accept the updated Terms.


3) Website Use Rules

You agree not to:

  • use the website for unlawful purposes;

  • interfere with the website’s security or operation;

  • attempt to gain unauthorized access to accounts, data, or systems;

  • copy, scrape, reverse-engineer, or misuse website content or systems.

We may suspend or block access if we believe you are violating these Terms.


4) Orders, Acceptance, Pricing, and Availability

Order acceptance: Your order is an offer to buy. We may accept, reject, or cancel orders (in whole or in part) for reasons including inventory, pricing errors, suspected fraud, shipping limitations, or supplier constraints.

Pricing/description errors: If an item is listed incorrectly (price, specs, availability), we may correct the error and cancel/refund the affected portion of the order.

Taxes: Sales tax and other applicable charges may apply and will be shown at checkout when required.


5) Shipping, Delivery, and Risk of Loss (Products)

  • Delivery dates are estimates and not guaranteed.

  • Customers must provide accurate delivery information and ensure safe/accessible delivery conditions.

  • Inspect shipments immediately and report damage/shortages within the timeframe in our Return & Refund Policy.

  • Risk of loss transfers as allowed by law and carrier terms (especially for freight deliveries).


6) Return & Refund Policy (Products)

Product returns are governed by our Return & Refund Policy, which is incorporated into these Terms by reference. Key points:

  • 14-day return request window from delivery/pickup;

  • 25% restocking fee on any approved return;

  • many items are not returnable, including installed/cut/opened materials and partial cartons.

Your return eligibility and refund amount depend on the item condition, packaging, and supplier/freight rules.


7) Installation Services Purchased Online

If you purchase installation (or a product + installation bundle) through the website, the installation portion is also governed by our Installation Terms & Conditions (the “Installation Terms”), which may be presented at checkout, in an estimate/proposal, invoice, or as a separate agreement requiring your approval/signature. If there is a conflict between these Terms and the Installation Terms, the Installation Terms control for installation work.

7.1 Deposit and Payments

  • 50% deposit required to schedule installation and (when applicable) order materials.

  • Deposit becomes non-refundable once materials have been ordered for your project.

  • Remaining balance is due in full on the day of completion (same day).

7.2 Credit/Debit Card Processing Fee

Credit/debit payments are subject to a 3.5% processing fee (where permitted) added to the invoice/checkout total.

7.3 Late Fees and Returned Payments

  • Past due balances may be charged a late fee of 5% per month or the maximum allowed by law (whichever is less).

  • Returned/dishonored checks may be charged a service fee not exceeding $30 or 5% of the check amount (whichever is greater), plus any bank fees charged to us, as permitted under Georgia law.


8) Unknown Conditions, Subfloor Issues, and Change Orders (Installation)

Customer acknowledges that flooring/substrate conditions are often unknown until existing surfaces are removed. Hidden conditions may include subfloor damage, rot, moisture, slab issues, unevenness, prior improper installs, mold, structural movement, or plumbing-related damage.

  • Any additional corrective work required for a proper installation (e.g., subfloor repair, patching, leveling, skim coating, moisture mitigation) is not included unless specifically listed in writing and will require a written change order.

  • Change orders must be approved and may be required before installation proceeds.

If Customer Stops the Project After Work Begins

If the project is paused/cancelled/terminated after commencement (including after demolition/removal), Customer remains responsible for:

  1. all work performed to date (demo/removal, mobilization, disposal, labor, site protection), plus

  2. all material costs incurred/ordered (including freight, restocking, non-returnables), plus

  3. any minimum charge / crew reservation / project interruption fee disclosed in your estimate/proposal/checkout or Installation Terms (intended to cover schedule disruption and lost opportunity).

These types of pre-agreed damages are intended to be enforceable as liquidated damages in Georgia when reasonably drafted and not punitive.

iProStep is not obligated to reinstall removed flooring/surfaces once removed, and will leave the area in a reasonably safe condition as practical.


9) Permits; Plumbing and Electrical

  • Customer is responsible for obtaining any required permits unless explicitly included in writing.

  • Plumbing/electrical work is not included unless specifically stated; it may be subcontracted to qualified trades at additional cost. Minor plumbing work may be performed only if expressly authorized and lawful.


10) Warranty and Disclaimers

10.1 Installation Warranty (Labor Only)

iProStep provides a 1-year warranty on installation workmanship only, starting at substantial completion, subject to exclusions in the Installation Terms (including moisture/HVAC/improper use exclusions).

10.2 Product Warranty (Manufacturer)

Products/materials are covered (if at all) by the manufacturer’s warranty. iProStep does not provide a product/manufacturer warranty.

10.3 Environmental / Improper Use Exclusions

Damage caused by moisture intrusion, leaks, flooding, standing water, excessive humidity, lack of proper HVAC/temperature control, improper cleaning methods, unapproved chemicals/tools, pet damage, dragged furniture, or other misuse is excluded from installation warranty coverage.


11) Customer-Supplied Materials

If you supply your own materials:

  • iProStep does not warranty product quality, compatibility, or completeness.

  • Delays or extra labor caused by missing/incorrect/damaged customer materials may result in additional charges and rescheduling fees.


12) Intellectual Property

All website content (logos, images, text, designs, and trademarks) is owned by iProStep or its licensors and may not be used without written permission.


13) Third-Party Links and Services

Our website may link to third-party sites or services. We are not responsible for their content, policies, or practices.


14) Limitation of Liability

To the maximum extent permitted by law:

  • iProStep is not liable for indirect, incidental, special, consequential, or punitive damages (loss of use, hotel costs, lost profits, etc.).

  • iProStep’s total liability for any claim is limited to the amount paid to iProStep for the specific product/service giving rise to the claim.


15) Indemnification

You agree to indemnify and hold iProStep harmless from claims arising out of your breach of these Terms, misuse of the website, or violation of laws/third-party rights.


16) Dispute Resolution and Governing Law (Georgia)

These Terms are governed by Georgia law. Disputes will first be addressed through good-faith discussion. If unresolved, either party may request mediation. If still unresolved, disputes will be brought in the state or county courts in Georgia located in:

  • the county where the project occurred (if applicable), or

  • the county of iProStep’s principal office,
    as permitted by law.


17) Electronic Communications and E-Sign

You consent to receive communications electronically (email/SMS/website notices). Checkout acceptance, electronic signatures, and electronic approvals are binding to the extent permitted by law.
